AN ACT relative to fish and game department expenditures for marine fisheries, and relative to the membership and reporting date of the commission to study recommendations of the New Hampshire estuaries project management plan.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to fish and game department expenditures for marine fisheries, and relative to the membership and reporting date of the commission to study recommendations of the New Hampshire estuaries project management plan.

Be it Enacted by the Senate and House of Representatives in General Court convened:

104:1 Marine Fisheries Fund; Reference Removed. Amend RSA 211:68 to read as follows:

211:68 Executive Director of Fish and Game. The executive director of fish and game shall exercise general supervision over the division of marine fisheries[, authorize expenditures from the marine fisheries fund] and is authorized to hold hearings and [issue regulations] adopt rules as provided by statute.

104:2 Marine Fisheries Fund; Reference Removed. Amend RSA 211:69 to read as follows:

211:69 Chief of Division. The executive director of the fish and game department shall appoint a marine biologist of adequate training and experience to be the chief of the division of marine fisheries. The executive director shall employ the necessary office, enforcement, and field help for the control and the promotion of marine fisheries within the funds available for the division. [Until such time as a permanent appointment of a marine biologist is made, the executive director of fish and game may employ a consultant to set up the program of the division and to train suitable biologists and other employees. The executive director of fish and game is authorized to spend not over $6,000 a year for the services of the consultant payable from the marine fisheries fund. The executive director of fish and game may not employ a consultant for this purpose for a period longer than 2 years after the effective date of this subdivision.]

104:3 New Subparagraphs; Commission to Study Implementing a Recommendation of the New Hampshire Estuaries Project Management Plan; Members Added. Amend 2003, 236:2, I by inserting after subparagraph (k) the following new subparagraphs:

(l) The president of the New Hampshire Commercial Fishermen’s Association, or designee.

(m) The president of the Coastal Conservation Association of New Hampshire, or designee.

104:4 Reporting Date Extended. Amend 2003, 236:5 as amended by 2004, 20:11 to read as follows:

236:5 Report. The commission shall report its findings and any recommendations for proposed legislation to the senate president, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, [2005] 2006.

104:5 Repeal. The following are repealed:

I. RSA 211:67, relative to acceptance of gifts and grants for marine fisheries.

II. RSA 211:70, relative to marine fisheries revenue.

104:6 Effective Date.

I. Sections 3 and 4 of this act shall take effect upon its passage.

II. The remainder of this act shall take effect 60 days after its passage
