AN ACT relative to the sale of lead fishing sinkers and jigs and establishing a study committee on New Hampshire’s loon population.

This bill changes the maximum fine, application, and effective date for laws relating to lead fishing sinkers and jigs. The bill also establishes a committee to study issues related to the loon population in New Hampshire.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to the sale of lead fishing sinkers and jigs and establishing a study committee on New Hampshire’s loon population.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fish and Game; Lead Fishing Sinkers and Jigs; Fine. Amend RSA 211:13-b, II to read as follows:

II. A person using any such lead sinker or jig shall be guilty of a violation. Notwithstanding RSA 651:2, the penalty for a violation of this section shall not exceed [$250] $50.

2 Sale of Lead Fishing Sinkers and Jigs; Prospective Version Amended. Amend 2004, 172:2 and 3 to read as follows:

172:2 New Subdivision; Sales of Certain Articles; Lead Fishing Sinkers and Jigs. Amend RSA 339 by inserting after section 76 the following new subdivision:

Lead Fishing Sinkers and Jigs

339:77 Lead Fishing Sinkers and Jigs; Sale Prohibited. No person shall sell or offer for sale within the state of New Hampshire a lead sinker or lead jig to any person holding a current New Hampshire fishing license who intends to use the lead sinker or lead jig in the waters of New Hampshire. The definition of lead sinker and lead jig in RSA 211:13-b, IV shall apply to this section. Any person who violates this section shall be guilty of a violation. Notwithstanding RSA 651:2, the penalty for a violation of this section shall not exceed $50.

172:3 Effective Date.

I. Section 2 of this act shall take effect January 1, [2006] 2007.

II. The remainder of this act shall take effect January 1, 2005.

3 Committee Established. There is established a committee to study issues related to the loon population in New Hampshire.

4 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

5 Duties. The committee shall study issues related to the loon population in New Hampshire.

6 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

7 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the senate president, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2005.

8 Effective Date. This act shall take effect upon its passage.
