AN ACT relative to minutes of land use board meetings involving developments of regional impact.

ANALYSIS

This bill increases the amount of time following a decision on a development of regional impact before a local land use board is required to provide plans and minutes to the regional planning commission and other affected communities.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to minutes of land use board meetings involving developments of regional impact.

Be it Enacted by the Senate and House of Representatives in General Court convened:

39:1 Review of Developments of Regional Impact; Procedure; Increase in Period Before Notice Required. Amend RSA 36:57, II to read as follows:

II. Within [72] 144 hours of reaching a decision regarding a development of regional impact, the local land use board having jurisdiction shall, by certified mail, furnish the regional planning commission and the affected municipalities with copies of the minutes of the meeting at which the decision was made. The local land use board shall, at the same time, submit an initial set of plans to the regional planning commission, the cost of which shall be borne by the applicant.

39:2 Effective Date. This act shall take effect 60 days after its passage.
