STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT establishing a commission to effect the process for the town of Killington, Vermont to become part of the state of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

136:1 Commission Established. There is hereby established and created a commission to be known as the “Killington Incorporation Commission” to effect the process and terms of an interstate agreement by which the town of Killington, Vermont would become part of the state of New Hampshire.

136:2 Composition of Commission; Terms. The commission shall be composed of 3 members, one of whom shall be appointed by the governor, one of whom shall be appointed by the senate president, and one of whom shall be appointed by the speaker of the house of representatives. Commission members shall be residents and voters of New Hampshire, and shall serve until their successors are appointed. Members of the commission shall serve without compensation.

136:3 Duties. It shall be the duty of the commission, and the commission is hereby authorized and directed, to meet with its counterpart from the state of Vermont in order to make inquiry, to ascertain, and to negotiate the most advantageous and appropriate terms and means for incorporating the town of Killington into the state of New Hampshire. In so doing, the commission shall work cooperatively with its counterpart Vermont commission to draft and recommend to the governors and legislators of the states of New Hampshire and Vermont legislation in furtherance of the foregoing.

136:4 Commission Meetings; Actions. The commission shall appoint a chairperson from among the members and shall meet as often as is required in order to carry out its duties. All actions taken by the commission shall be by majority vote of its members. The first meeting of the commission shall be held by the first-named member within 45 days of the effective date of this section.

136:5 Submittal of Proposed Legislation. The commission shall submit proposed legislation to the governor, house of representatives, and senate no later than one year from the effective date of this section, or one year from the date of creation of the commission’s Vermont counterpart, whichever is later.

136:6 Assistance of Attorney General. The commission is authorized to call upon the resources of the office of the attorney general for purposes of obtaining legal counsel, and the attorney general is directed to furnish the commission with such legal assistance as may be necessary for the commission to carry out its duties.

136:7 Commission Meetings to be Public. All meetings of the commission for the consideration of and action on any matters coming before the commission shall be open to the public.

136:8 Effective Date. This act shall take effect upon its passage.
