STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to state matching funds for Federal Emergency Management Agency disaster assistance grants and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appropriation; Cheshire and Sullivan Counties; State Matching Funds for Federal Emergency Management Agency Disaster Assistance Grants. The sum of $182,484.75 is hereby appropriated to the department of safety, division of emergency management for the fiscal year ending June 30, 2005, for the required state match for the disaster assistance grant awarded by the Federal Emergency Management Agency (FEMA) to Sullivan and Cheshire counties for flood damage sustained in July and August of 2003. The appropriation shall equal 12.5 percent of eligible disaster-relief costs incurred by certain municipalities and agencies in Cheshire and Sullivan counties, based on payment of 75 percent of such costs by FEMA and payment of the remaining 12.5 percent by local government. Upon receipt of the appropriation, the department shall disperse the funds proportionally to the identified towns and agencies for which the state matching funds are intended. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated. The appropriation shall be nonlapsing.

2 Payment of Interest on FEMA Disaster Assistance Grants. Interest on any disaster assistance grant from FEMA that is held by the state but not yet distributed shall accrue to the municipality or agency for which the grant is intended.

3 Effective Date. This act shall take effect upon its passage.

AN ACT relative to state matching funds for Federal Emergency Management Agency disaster assistance grants and making an appropriation therefor.

FISCAL IMPACT:

The New Hampshire Municipal Association and Department of Safety state this bill will increase state general fund expenditures and local revenues by $182,484.75 in FY 2005. This bill will have no fiscal impact on state and county revenue or county and local expenditures.

This bill appropriates $182,484.75 from the general fund to the Department of Safety, Division of Emergency Management in FY 2005.

METHODOLOGY:

The New Hampshire Municipal Association states this bill appropriates $182,484.75 in general funds in FY 2005 to the Department of Safety, Division of Emergency Management in order to provide a State match for FEMA funds used to compensate municipalities in Cheshire and Sullivan counties for expenses incurred as a result of flood damage sustained in July and August 2003. FEMA funds comprise 75% of the cost of the damages, and the remaining 25% is split between the State and the municipalities. The Association states that without the appropriation for the State match (12.5%), the affected municipalities would have to pay the entire 25% match, thus doubling the local costs for the damages.

The Department of Safety states this bill intends to appropriate State matching funds against Federal disaster assistance grants provided to certain municipalities and other agencies in Cheshire and Sullivan counties. This bill also states that interest on any unpaid Federal disaster assistance grant shall accrue to the agency for which the grant is intended, however, the Department believes that all of the federal grant funds have been disbursed to the appropriate agencies.

The Association of Counties state this bill will have no fiscal impact on county revenue or expenditures.
