STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT establishing a commission to study the barriers to the establishment of all-terrain vehicle trails on public and private lands.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the barriers to the establishment of all-terrain vehicle (ATVs) trails and the means of addressing such barriers.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Two members of the senate, appointed by the president of the senate.

(c) The commissioner of the department of environmental services, or designee.

(d) The commissioner of the department of resources and economic development, or designee.

(e) The commissioner of the fish and game department, or designee.

(f) One representative of the Appalachian Mountain Club-New Hampshire Chapter, appointed by the chairperson of the executive committee.

(g) One representative of the New Hampshire Municipal Association, appointed by such association.

(h) One representative of the New Hampshire Off Highway Vehicle Association, appointed by the president of the executive committee.

(i) The director of the office of energy and planning, or designee.

(j) One representative of the New Hampshire Snowmobile Association, appointed by the president of such association.

(k) One representative of New Hampshire landowners, appointed by mutual agreement of the New Hampshire Farm Bureau Federation and the New Hampshire Timberland Owners Association.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall study the following issues associated with ATV use in the state:

I. Sources of revenue for establishing trails and the effect on trail development.

II. Organizational responsibilities for trail development.

III. Methods of establishing the best location for trails on public and private land, including environmental, social, municipal, recreational, and economic factors.

IV. Responsibility for, and economics of, trail construction and maintenance.

V. Adequacy and enforcement of ATV regulations and policies, and means of addressing environmental impact and the problems of users, abutters, and municipalities.

4 Chairperson; Quorum. The members of the study commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

6 Effective Date. This act shall take effect upon its passage.
