STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT increasing the mileage reimbursement rate for members of the legislature.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 General Court; Travel Allowance to Members. Amend RSA 14:15-a, I(b)(1) and (2) to read as follows:

(1) For the first 45 miles, [$.38] $.76 per mile; and

(2) For all miles in excess of 45 miles, [$.19] $.38 per mile.

2 Application. The rates for travel allowances for members of the general court provided for in RSA 14:15-a, I(b) as amended by section 1 of this act shall be used for calculation of the reimbursement to members beginning with travel occurring on or after January 1, 2006.

3 Effective Date. This act shall take effect 60 days after its passage.

HB 392-FN - FISCAL NOTE

AN ACT increasing the mileage reimbursement rate for members of the legislature.

FISCAL IMPACT:

      The Office of Legislative Accounting states this bill will increase state general fund expenditures by $109,182 in FY 2006, $204,685 in FY 2007, $145,576 in FY 2008, and $204,685 in FY 2009. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Office states this bill would increase the mileage reimbursement rate for members of the Legislature who choose to be reimbursed using the state rate from 38 cents per mile for the first forty-five miles to 76 cents per mile, and from 19 cents per mile for all miles in excess of forty-five miles to 38 cents per mile. The proposed rate would take effect for travel occurring on or after January 1, 2006. The Office used the current “state rate” roster to determine the fiscal impact, and has made the following assumptions:

      • Miles reimbursed are the same as in FY 2003 and FY 2004;

      • No change in payroll tax of 7.65%;

      • 75% of FY 2006 mileage expenditures will occur between January 1 and June 30, 2006; and

      • No consideration was given to members changing their election from federal to state rate for the proposed rate estimates. Such changes are reflected in the current rate estimates since the office used actual expenditure figures from FY 2003 and FY 2004 for these estimates.

    The estimated fiscal impact is as follows:
