AN ACT establishing a committee to study the leasing of state-owned conservation land to private entities and relative to a temporary prohibition on the leasing of such lands.

This bill establishes a committee to study the leasing of state-owned conservation land to private entities and prohibits any department, agency, or political subdivision of the state from initiating, altering, or executing a lease of state-owned conservation land to a private entity until the study committee has submitted its final report, or until November 1, 2006, whichever is later.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT establishing a committee to study the leasing of state-owned conservation land to private entities and relative to a temporary prohibition on the leasing of such lands.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a committee to study the leasing of state-owned conservation land to private entities.

2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties. The committee shall:

I. Study the policies and procedures involved in the leasing of state-owned conservation land to private entities, especially where this issue involves the leasing of land in Mount Sunapee state park to private entities.

II. Study the legality and implications of leasing or selling conservation land that was given to the state or taken by eminent domain for conservation purposes.

III. Identify reasonable limits on growth and commercial development in the state parks which are consistent with the purpose of the state park system.

IV. Study any other issues deemed relevant to the committee’s purpose.

V. Consult with a representative from the board of selectmen, or designee, from the towns of Goshen and Newbury to assist the committee in its duties.

4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

6 Temporary Prohibition on Lease of State-Owned Land to Private Entities. No department, agency, or political subdivision of the state shall initiate, alter, or execute a lease of state-owned conservation land to a private entity until the study committee established in sections 1-5 of this act has submitted its final report, or until November 1, 2006, whichever is later.

7 Effective Date. This act shall take effect upon its passage.
