In the Year of Our Lord Two Thousand Five
AN ACT relative to application for a writ of habeas corpus.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Habeas Corpus; Application. RSA 534:3 is repealed and reenacted to read as follows:
534:3 Application. Application for the writ shall be made by the human being incarcerated or restrained to the superior court in the county in which he or she is imprisoned, or by any other human being acting for the benefit of the incarcerated.
2 Effective Date. This act shall take effect January 1, 2006.
