This bill establishes a New Hampshire advantage commission to examine tax incentives offered by the United States, other countries, and other states which could be adopted by this state to improve its economic position in the United States and the world, and to make recommendations for establishing a unit within the office of the legislative budget assistant to maintain current tax information and data for legislators.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT establishing a New Hampshire advantage commission.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the tax laws of all 50 states, the United States and United States possessions, as well as countries which are considered international tax havens, and to determine which incentives offered by these jurisdictions could be adopted by the state of New Hampshire to improve its economic position in the United States and in the world.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

(c) The commissioner of the department of revenue administration, or designee.

(d) The commissioner of resources and economic development, or designee.

(e) The legislative budget assistant, or designee.

(f) Six public members, with tax and business experience applicable to the responsibilities of the commission, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties.

I. The commission shall study the tax laws of all 50 states, the United States and United States possessions, as well as countries which are considered international tax havens, and shall determine which incentives offered by these jurisdictions could be adopted by the state of New Hampshire to improve its economic position in the United States and in the world.

II. The commission shall make specific recommendations for establishing a unit within the office of the legislative budget assistant responsible for gathering and maintaining current tax information and data for use by legislators.

4 Chairperson; Meetings. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section

5 Report. The commission shall make an interim report on or before November 1, 2005 and a final report on or before November 1, 2006 on its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.

6 Effective Date. This act shall take effect upon its passage.
