AN ACT relative to the disclosure of department of revenue administration records for purposes of assisting the state in the recovery of medical assistance.

ANALYSIS

This bill permits the department of revenue administration to release otherwise confidential financial records to the department of health and human services to recover the cost of medical assistance provided to a decedent with a revocable trust.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to the disclosure of department of revenue records for purposes of assisting the state in the recovery of medical assistance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Department of Revenue Administration; Confidentiality of Department Records; Exception Added. Amend RSA 21-J:14, V(d) by inserting after subparagraph (7) the following new subparagraph:

(8) An officer or employee of the department of health and human services responsible for the recovery of medical assistance under RSA 167:14-a, V, provided that the disclosure under this subparagraph shall be limited to the report of the trust and a copy of the document, including any list of beneficiaries, in accordance with RSA 87:20.

2 Effective Date. This act shall take effect 60 days after its passage.
