AN ACT relative to amending warrant articles in towns that have adopted the official ballot form of town meeting.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to amending warrant articles in towns that have adopted the official ballot form of town meeting.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Amended Warrant Articles. RSA 40:13, IV(b) is repealed and reenacted to read as follows:

(b) The original text of the warrant article prior to amendment shall appear on the official ballot next to a YES box and a NO box in which to make a mark. The text of the warrant article after amendment shall appear immediately below the original text and next to a YES box and a NO box in which to make a mark. The voter shall mark the YES or NO box for the original text in accordance with his or her choice, then shall mark the opposite box for the amended text. Unless otherwise required, a simple majority YES vote is required to pass. If the original text and the amended text both pass, the text that receives the greatest number of YES votes shall prevail. In the event of a tie vote, then the original warrant article shall prevail.

2 Effective Date. This act shall take effect 60 days after its passage.
