HOUSE BILL 1215
AN ACT relative to the winter maintenance of Diamond Pond Road in the towns of Colebrook and Stewartstown.

This bill increases the winter maintenance payment to the towns of Colebrook and Stewartstown for maintaining the state road to Diamond Pond from $1,500 to $2,500 per mile and provides for future payments to be 102 percent of the previous biennium’s payment. The payment was last increased in 1985.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT relative to the winter maintenance of Diamond Pond Road in the towns of Colebrook and Stewartstown.
Be it Enacted by the Senate and House of Representatives in General Court convened:
175:1 Increased Reimbursement Rate. Amend 1967, 382:1 as amended by 1977, 405:1 as amended by 1985, 160:1, to read as follows:
382:1 Winter Road Maintenance in Colebrook and Stewartstown. The commissioner of [public works and highways] transportation is hereby authorized to reimburse the towns of Colebrook and Stewartstown at the rate of [$1,500] $2,500 a mile for the winter maintenance of 4.33 miles of the class III highway, known as the Diamond Pond Road, from the Harvey Swell intersection to its end at Big Diamond Pond, from January 1 until April 1 of each year.
175:2 Winter Maintenance by State. Amend 1967, 382:2 as amended by 1977, 405:2 as amended by 1985, 160:2, to read as follows:
382:2 Winter Maintenance by the State. When the class III highway, known as the Diamond Pond Road, has been bituminous surfaced and in the opinion of the commissioner of [public works and highways] transportation the traffic volume warrants winter maintenance by the state he or she may in his or her discretion discontinue the reimbursement for winter maintenance of [$1,500] $2,500 a mile to the towns of Colebrook and Stewartstown and assume the winter maintenance by the department of [public works and highways] transportation.
175:3 Future Winter Maintenance Payments by State. For the biennium beginning July 1, 2007 and every biennium thereafter, the Diamond Pond Road maintenance payment calculated for the previous biennium shall be multiplied by 102 percent. The product shall be the payment to the towns of Colebrook and Stewartstown for the next biennium.
175:4 Effective Date. This act shall take effect 60 days after its passage.
