STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT including public officials under the real estate practice act.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Repeal. RSA 331-A:4, V, relative to exempting public officials from the real estate practice act, is repealed.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1233-FN - FISCAL NOTE

AN ACT including public officials under the real estate practice act.

FISCAL IMPACT:

      The Real Estate Commission states this bill will increase state revenue and expenditures by an indeterminable amount in FY 2006 and each year thereafter. This bill will have no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Commission states this bill removes the exemption for public officials in the conduct of official duties from the requirements of the real estate practice act. The Commission is unable to determine the fiscal impact on state funds and expenditures as a result of this bill since there is no current method available to know how many public officials would be affected. The current cost of a salespersons’ license is $70 and the cost for a broker’s license is $90. Licenses are required to be renewed every two years. The cost for renewal licenses is the same as an original broker and salesperson license. Any amendment to a license requires a $15 amendment fee. Revenue would increase to the extent these fees are paid. Any fiscal impact on expenditures would consist of labor and materials utilized to issue, renew, and amend licenses of public officials, and the maintenance of the license record information. Should a complaint be filed against a public official, expenditures would involve the labor and materials utilized for the complaint process, investigation, and disciplinary proceeding if required.
