AN ACT relative to the alteration of a portion of the town line between Milford and Amherst.

ANALYSIS

This bill changes the boundary line between the towns of Amherst and Milford by transferring a portion of territory from Amherst to Milford. Any change in the boundary between the towns must be approved by 2/3 of the voters in each town before it becomes effective.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the alteration of a portion of the town line between Milford and Amherst.

Be it Enacted by the Senate and House of Representatives in General Court convened:

4:1 Town Boundaries Changed; Amherst and Milford. The boundary line between the towns of Amherst and Milford in Hillsborough county is hereby changed to unite a portion of the territory of the town of Amherst with the town of Milford. The portion of the town of Amherst which shall be united with the town of Milford is more particularly bounded and described as follows:

The tract of land depicted on a plan of land entitled, “Town Line Adjustment Plan Adjacent to Summer Street Town of Amherst & Town of Milford Hillsborough County New Hampshire,” which plan is dated August 26, 2005 and is to be recorded in the Hillsborough County Registry of Deeds, being hereafter referred to as the “Plan,” said tract being more particularly bounded and described as follows:

Beginning at a point at a “Town Line Bound to be Set,” said bound constituting the southeasternnmost corner of the within described premises, which bound is on a tract of land currently identified on the Milford tax maps as map 22, lot 19, said point being S 83 degrees 25’ 49” W a distance of 413.42 feet from the next most easterly town bound, shown on said Plan as near property identified on the Milford tax maps as map 22, lot 29, said point also being just south of the southern boundary of property identified on the Milford tax maps as map 22, lot 19-1; thence,

1. N 10 degrees 31’ 03” W, a distance of 3,379.32 feet by a line entitled “Proposed Town Line” to a “Town Line Bound to be Set,” said point constituting the northeasternmost corner of the within described premises; thence, turning to the left and proceeding,

S 82 degrees 02’ 18” W, a distance of 248.83 feet to a “Town Bound Found,” which bound constituted a previously established corner of the town boundary between Milford and Amherst and is located N 82 degrees 02’ 18” E a distance of 3,278.29 feet from the next most westerly town bound shown on said Plan, said point constituting the northwesternmost corner of the within described premises; thence, turning to the left and proceeding,

3. S 14 degrees 07’ 43” E, a distance of 3,394.76 feet by a line entitled “Town Line to be Abandoned,” to a “Town Bound Found,” which bound constituted a previously established corner of the town boundary between Milford and Amherst and is located S 83 degrees 25’ 49” W a distance of 34.84 feet from the “Town Line Bound to be Set” which constituted the point of beginning, the within point being the southwesternmost corner of the within described premises; thence, turning to the left and proceeding,

4. N 83 degrees 25’ 49” E a distance of 34.84 feet crossing, at an angle, the boundary line between properties identified on the Milford tax maps as map 22, lot 19-1 and map 22, lot 19, respectively, as shown on said Plan, to the point of beginning.

4:2 Vote of the Towns of Milford and Amherst Required. Pursuant to RSA 51:9, the change in the boundary between Milford and Amherst shall not become effective until ratified by 2/3 of the voters of each of the towns of Milford and Amherst, present and voting by ballot at the regular annual or biennial meeting for the election of town or city officers held next after the passage of this act.

4:3 Contingency. If 2/3 of the voters of each of the towns of Milford and Amherst, present and voting as prescribed in section 2 of this act, vote to approve the change in the boundary between the towns, then section 1 of this act shall take effect upon the vote of the second town to approve. If fewer than 2/3 of the voters of either town vote to approve the change in the boundary between the 2 towns, then section 1 of this act shall not take effect.

4:4 Effective Date. This act shall take effect upon its passage.
