STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to automobile insurance coverage for drivers in the same household as the policyholder.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Automobile Insurance; Requirements of Coverage; Household Members. Amend RSA 412:8 by inserting after paragraph II the following new paragraph:

III. If a driver other than the policyholder resides at the same residence as the policyholder, the insurer shall permit the policyholder to decide whether to add the driver to the policy or to decline coverage for the driver. If the policyholder declines coverage, the insurer shall offer to insure the driver under a separate policy of automobile insurance. The insurer may require, as a condition of declining coverage, that the policyholder execute a waiver of liability for the uninsured driver.

2 Effective Date. This act shall take effect January 1, 2007.
