AN ACT relative to the application of the capital murder statute.

ANALYSIS

This bill removes the restrictions in the capital murder statute and permits any person charged with knowingly causing the death of another to be sentenced to the death penalty.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the application of the capital murder statute.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Repeal. The following are repealed:

I. RSA 630:1, I, relative to charging the death of certain persons as capital murder.

II. RSA 630:1, II, relative to the definition of “law enforcement officer.”

III. RSA 630:1, II-a, relative to the definition of “judicial officer.”

2 Effective Date. This act shall take effect January 1, 2007.
