STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing a commission to study revising the New Hampshire special education statutes.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study revising the New Hampshire special education statutes.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Two members of the senate, appointed by the president of the senate.

(c) The special assistant to the commissioner of the department of education.

(d) The director of the division of educational improvement, department of education, or designee.

(e) Two representatives of the Parent Information Center, appointed by such organization.

(f) One member of the advisory committee on the education of children/students with disabilities established in RSA 186-C:3-b, appointed by the chairperson of the committee.

(g) Two representatives of the New Hampshire Association of Special Education Administrators, appointed by such association.

(h) Two members of the public, one of whom shall be appointed by the speaker of the house of representatives and one of whom shall be appointed by the president of the senate.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall:

I. Study the interface between state and federal special education statutes and how school districts implement such statutes.

II. Study RSA 186-C and recommend changes deemed necessary by the commission.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson and a clerk from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before July 1, 2007.

6 Effective Date. This act shall take effect upon its passage.
