AN ACT relative to qualifications for police chiefs in towns with populations of more than 3,000.

ANALYSIS

This bill requires a person who files as a candidate for elected police chief in a town with a population of more than 3,000 to be certified by the police standards and training council. The bill permits the candidate to be a resident of any town in the state.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to qualifications for police chiefs in towns with populations of more than 3,000.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Education and Training Required; Elected Police Chiefs. Amend RSA 188-F:27 by inserting after paragraph II the following new paragraph:

II-a. Notwithstanding the provisions of paragraph II, no person shall be considered qualified to run for the office of elected chief of police in any town with a resident population of more than 3,000 that employs one or more full-time police officers, unless such candidate furnishes the town clerk with a certified statement from the director of the police standards and training council that such person is currently a certified full-time police officer in good standing, and the town clerk shall not allow any person to register for such office without furnishing such proof of qualifications. This paragraph shall not apply to any elected police chief in any town who was serving on the effective date of this paragraph and who files for reelection to the same post. Notwithstanding any provision of law to the contrary, a candidate for the position of chief of police in a town may be a resident of any town in the state and shall not be required to be a resident of the town in order to file for election or reelection.

2 Effective Date. This act shall take effect upon its passage.
