HOUSE BILL 1327
AN ACT requiring a vote by the tenants who are owners of manufactured housing park units prior to purchase of the manufactured housing park by the tenant or tenants’ association.

In the Year of Our Lord Two Thousand Six
AN ACT requiring a vote by the tenants who are owners of manufactured housing park units prior to purchase of the manufactured housing park by the tenant or tenants’ association.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Subdivision Heading and Section Heading. Amend the subdivision heading preceding RSA 205-A:21 and the section heading of RSA 205-A:21 to read as follows:
Tenants’ Right to Notification and Unit Owners’
Majority Vote Required Prior to Park Sale
205-A:21 Notice and Majority Vote Required Before Sale.
2 New Paragraph; Notice Required Before Sale; Majority Vote Required. Amend RSA 205-A:21 by inserting after paragraph III the following new paragraph:
IV. Any offer to purchase any manufactured housing park by the tenants or tenants’ association shall require an affirmative majority vote by all the tenants who are owners of park units at a duly notified meeting of the unit owners. This meeting shall be held within 30 days of the date of any offer to purchase the park and shall be conducted by a third party who is disinterested in the proposed sale of the park. This third party shall be agreed to by both the owners of the park and the tenants who own units in the park. Proxy votes shall be allowed by the use of a certified vote, witnessed by a justice of the peace. All proxy votes shall be postmarked no later than the day prior to the vote.
3 Effective Date. This act shall take effect upon its passage.
