AN ACT relative to voting procedures for local land use boards.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to voting procedures for local land use boards.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Scheduling of Meetings; Conduct Added. Amend the section heading of RSA 673:10 to read as follows:

673:10 Scheduling and Conduct of Meetings.

2 New Paragraph; Scheduling and Conduct of Meetings; Tie Vote. Amend RSA 673:10 by inserting after paragraph III the following new paragraph:

IV. In any local land use board created under this chapter, a motion disposing of an application shall be made in favor of approving the application. The chairperson shall declare any dispositive motion which results in a tie vote to be a vote in favor of the applicant.

3 Effective Date. This act shall take effect 60 days after its passage.
