STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to licensure, registration, or certification of regulated professions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; General Administration of Regulatory Boards and Commissions; Criteria for Licensure, Registration, or Certification. Amend RSA 332-G by inserting after section 4 the following new section:

332-G:5 Criteria for Licensure, Registration, or Certification. The following criteria shall be applied to state regulatory board and commissions:

I. Licensing means the process by which a state licensing board or commission is required to grant permission to an individual to engage in a regulated occupation upon finding that the applicant has attained the requirements of competency set forth in each profession’s licensing statute. A person shall be prohibited from engaging in the regulated occupation without a license. A licensee has to meet certain requirements set forth in law, such as:

(a) Educational training.

(b) Experience.

(c) Minimum age.

(d) Residency.

(e) Years of formal education or academic degrees.

(f) Evidence of good moral character.

(g) Continuing education.

II. Certification means that a person may engage in a regulated occupation as specified in the controlling certification statute. Only those individuals who have met the defined standards may use the term “certified” so that the public is able to differentiate between those who have met defined standards and those who are not certified. The minimum standard shall be:

(a) Completion of an accredited or approved educational program.

(b) Acceptable performance on a qualifying examination.

(c) Completion of a specified amount of work experience.

III. Registration means that a person who engages in a given occupation only has to register with an agency, board, or commission with no need to pass an examination or to show competency. The requirements are:

(a) List one’s name and address.

(b) Pay a fee.

(c) A bond may be required.

2 Effective Date. This act shall take effect 60 days after its passage.
