ANALYSIS

This bill establishes a committee to study the feasibility of transferring case management responsibility from the department of health and human services to the counties for certain elderly and adult service programs.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing a committee to study case management responsibility for certain elderly and adult services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a committee to study case management responsibility for certain elderly and adult services.

2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties.

I. The committee shall study the feasibility of transferring case management responsibility for the following programs from the department of health and human services, bureau of elderly and adult services to the counties:

(a) Programs funded under Title III of the Older Americans Act of 1965, 42 U.S.C. sections 3001-3058ee.

(b) Programs funded through a Title XX block grant under the Social Security Act.

(c) Protective service programs under RSA 161-F, including abuse investigations under RSA 161-F:46.

II. For each program, the committee shall consider the costs and benefits associated with transferring case management responsibility to the counties and, if appropriate, recommend a procedure and timeline for completing the transfer.

III. The committee shall solicit information and testimony from the department of health and human services, bureau of elderly and adult services, the department of justice, the state police, and at least one instructor at from the police academy with relevant experience and expertise, as well as such additional organizations and individuals as the committee determines may be of assistance in the performance of its duties.

4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

6 Effective Date. This act shall take effect upon its passage.

HB 1359-FN - FISCAL NOTE

AN ACT enabling municipalities to assume case management authority for certain elderly and adult programs.

FISCAL IMPACT:

      The Department of Health and Human Services and New Hampshire Municipal Association stated this bill may increase local expenditures by an indeterminable amount in FY 2006 and each year thereafter. There will be no fiscal impact on state, county and local revenue or state and county expenditures.

METHODOLOGY:

    The Department is unable to determine how many cities or towns currently provide or will choose to provide these services. The Department is not able to determine which services would specifically constitute elderly and adult services or the number of individuals that would receive the services. The Department does not expect this bill would impact state revenue or expenditures since it currently has a licensing program and could implement this change without needing additional resources.

    The New Hampshire Municipal Association assumes this bill requires that municipalities include case management as part of any program for the aged run by the municipality. The Association stated this requirement would increase the cost of running the programs. The increase in cost would depend on the number of elderly citizens participating in a particular municipal program.

    The New Hampshire Association of Counties stated this bill will have no fiscal impact on county revenue or expenditures since these programs are not an obligation of county government.
