STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT requiring horse owners to inoculate horses against eastern equine encephalitis.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Eastern Equine Encephalitis. Amend RSA 436 by inserting after section 123 the following new subdivision:

Eastern Equine Encephalitis

436:124 Definitions. In this subdivision:

I. “Commissioner” means the commissioner of health and human services.

II. “EEE” means eastern equine encephalitis.

III. “Equine” means horses, including ponies.

436:125 Vaccination Required.

I. When the commissioner determines that EEE presents a threat to the human population, consistent with RSA 125:9, the commissioner shall require equine owners to vaccinate all equines owned in the state of New Hampshire against EEE.

II. Any equine owner who violates the provisions of paragraph I shall be guilty of a violation and assessed a fine not less than $100 and not more than $500 per violation.

2 Effective Date. This act shall take effect January 1, 2007.
