STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing a commission to study the efficacy of current laws in reducing exposure of children to lead hazards.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the efficacy of current laws in reducing exposure of children to lead hazards.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

(c) The commissioner of the department of environmental services, or designee.

(d) The commissioner of the department of health and human services, or designee.

(e) The commissioner of the department of education, or designee.

(f) A member of the New Hampshire Pediatric Society, appointed by the society.

(g) A member of the Northern New England division of the United States Department of Housing and Urban Development, appointed by the division.

(h) A member of New Hampshire Legal Assistance, appointed by such office.

(i) The executive director of the New Hampshire housing finance authority.

(j) A consumer of rental housing, appointed by the governor.

(k) A landlord, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall study the efficacy of current laws in reducing exposure of children to lead hazards and examine ways in which to prevent children from becoming lead poisoned. The commission shall also seek input from a municipal health department and any other person or entity the commission deems relevant to its study.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

6 Effective Date. This act shall take effect upon its passage.
