STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to licensure of septic system inspectors.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Sewage Disposal Systems; Septic System Inspector. Amend RSA 485-A by inserting after section 36 the following new section:

485-A:36-a Septic System Inspector. No person shall engage in the business of inspecting existing septic systems at property transfers without first obtaining an inspector’s license from the department. The department shall issue an inspector’s license to any person who submits an application provided by the department, pays a fee of $40 and demonstrates a sound working knowledge of RSA 485-A:29-35. Licenses shall be issued from January 1 and shall expire December 31 of each year. Licenses shall be renewable upon proper application and payment of an annual fee of $40. The inspector’s license may be suspended, revoked, or not renewed for just cause. The department shall not suspend, revoke, or refuse to renew a license except for just cause until the permit holder has had an opportunity to be heard by the department. An appeal from such decision to revoke, suspend, or not renew a license may be taken pursuant to RSA 21-O:14. All fees shall be deposited with the state treasurer as unrestricted revenue.

2 Effective Date. This act shall take effect January 1, 2007.

HB 1456-FN - FISCAL NOTE

AN ACT relative to licensure of septic system inspectors.

FISCAL IMPACT:

      The Department of Environmental Services has determined this bill will increase state general fund revenue by $5,000 in FY 2007, $12,000 in FY 2008, and $14,000 in FY 2009 and each year thereafter. State expenditures will increase by $46,374 in FY 2007, $96,764 in FY 2008, $100,977 in FY 2009 and $105,329 in FY 2010. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department stated this bill is effective January 1, 2007, therefore, revenue and expenditures for FY 2007 reflect ½ a year. The Department estimated the number of potential individuals that would become licensed under this bill to be 250 in calendar year 2007, 300 in calendar year 2008, and 350 in calendar year 2009 and each year thereafter. Estimated revenues are based on an annual license and renewal fee of $40 per license, resulting in general fund revenue of $5,000 in FY 2007, $12,000 in FY 2008, and $14,000 in FY 2009 and each year thereafter.

    The Department further stated that in order to implement the program, two new positions, a Program Manager and a Secretary II are necessary. The Program Manager (Environmentalist IV) would have to have significant experience and education in the related wastewater treatment fields. The Program Manager would prepare rules, train licensees, prepare and administer examinations and handle renewals. The Secretary II would be necessary to carry out the related administrative functions. The cost of the positions is calculated as follows:
