AN ACT relative to electronic tracking and monitoring of sexual offenders.

ANALYSIS

This bill requires electronic monitoring of offenders against children and persons convicted of aggravated felonious sexual assault and felonious sexual assault. The bill allows for electronic monitoring of any person required to be registered as a criminal offender and provides that the cost of monitoring shall be paid by the offender.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to electronic tracking and monitoring of sexual offenders.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Sentences and Limitations; Electronic Tracking and Monitoring of Sexual Offenders. Amend RSA 651:2 by inserting after paragraph II-g the following new paragraph:

II-h. A person required to register under RSA 651-B who is placed on probation, parole, work release, or other type of conditional release, may be supervised by an electronic monitoring system in addition to any other conditions of release. If such person has been convicted under RSA 632-A:2 or RSA 632-A:3, or of any sexual offense against a minor, he or she shall be supervised with the use of an electronic monitoring system in addition to any other conditions of release. Any electronic monitoring ordered under this paragraph shall be for the duration of the release. The cost of monitoring under this paragraph shall be borne by the offender.

2 Effective Date. This act shall take effect July 1, 2007.
