STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT making various changes to the lottery commission.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Bond. Amend RSA 284:21-c to read as follows:

284:21-c Bond. Members of the commission shall give bond to the state in such amount as shall be determined under the provisions of RSA [93:2 as amended by 1957, 296:1] 93-B.

2 Compensation. Amend RSA 284:21-d to read as follows:

284:21-d Compensation. Each member of the commission shall receive a salary [of $2,400 per year] in accordance with RSA 94:1-a, II and shall be allowed reasonable expenses, including transportation, incurred in the performance of the member’s duties [to be audited and allowed by the governor and council].

3 Office. Amend RSA 284:21-e to read as follows:

284:21-e Office. The commission shall have an office in Concord or an adjacent community.

4 Disbursements. Amend RSA 284:21-f to read as follows:

284:21-f Disbursements. The compensation of the commissioners, expenses of the commissioners, compensation of assistants and other necessary expenses of the commission, including suitable furniture, equipment, supplies and office expense shall be charged to and paid out of the funds received under the provisions of this subdivision, provided that no payment shall be made until sufficient money has been received under the provisions of this subdivision to cover said payments. The department shall submit an operating budget based on program appropriation units or other budgetary units required by the general court. The department shall submit its budget in the same format and at the same time as other state agencies. However, the commission is authorized to transfer funds between line items within and among any budgetary unit. By October 31 of each fiscal year, the department shall submit a report to the fiscal committee of the general court detailing all transfers made during the last fiscal year and the reasons for them.

5 Report of the Commission. Amend RSA 284:21-g to read as follows:

284:21-g Report of the Commission. The commission shall make an annual report to the governor [on or before the first day of February in each year] in accordance with RSA 20:7, including therein an account of its actions, receipts derived under the provisions of this subdivision, the practical effects of the application thereof, and any recommendation for legislation which the commission deems advisable

6 Authorization; Sale of Tickets; Advertising. Amend RSA 284:21-h, I(a) to read as follows:

(a) To conduct public drawings at such intervals and in such places within the state as the commission may determine. [If governor and council grant approval, such drawings may be in the form of pure lotteries and if so, shall not be associated in any way with a sporting event.] Such drawings may also be associated with horse or dog races or both as hereinafter provided. [At least one such drawing each year shall be based on a sweepstakes horse or dog race or both held within the state.]

7 Authorization; Sale of Tickets; Advertising. Amend RSA 284:21-h, I(c) to read as follows:

(c) To conduct both pure lotteries and horse or dog [race] races or both [sweepstakes] lotteries if the commission, [with the approval of governor and council, shall determine] determines that such [program] programs will best accomplish the purposes of this subdivision.

8 New Paragraph; Multi-State Lottery Association. Amend RSA 284:21-i by inserting after paragraph V the following new paragraph:

VI. The commission may adopt rules, which shall be exempt from the provisions of RSA 541-A, for any multi-jurisdictional game conducted by the Multi-State Lottery Association.

9 New Subparagraph; Exception; Multi-State Lottery Association. Amend RSA 541-A:21, I by inserting after subparagraph (y) the following new subparagraph:

(z) RSA 284:21-i, V relative to rules for multi-jurisdictional games conducted by the Multi-State Lottery Association.

10 Effective Date. This act shall take effect 60 days after its passage.
