AN ACT relative to financial programs administered by the postsecondary education commission.

ANALYSIS

This bill:

I. Provides that funds received under the New Hampshire incentive program, the workforce incentive program, the leveraged incentive grant program, the granite state scholars program, the scholarships for orphans of veterans program, and the medical/veterinary/optometric education program shall be nonlapsing and continually appropriated to the postsecondary education commission.

II. Repeals the veterinary/medical education loan program.

STATE OF NEW HAMPSHIRE

AN ACT relative to financial programs administered by the postsecondary education commission.

Be it Enacted by the Senate and House of Representatives in General Court convened:

28:1 Postsecondary Education Commission; New Hampshire Incentive Program. Amend RSA 188-D:10 to read as follows:

188-D:10 Program Established. There is hereby established the New Hampshire incentive program providing grants for the benefit of residents of the state seeking or pursuing programs of study at postsecondary institutions [within the state]. All funds received pursuant to this section shall be nonlapsing and continually appropriated to the postsecondary education commission for the purposes of this program.

28:2 Postsecondary Education Commission; Responsibilities. Amend RSA 188-D:8, IX to read as follows:

IX. Establish and collect reasonable fees related to the performance of its degree-granting and research and studies functions. Such fees shall be deposited into the essential functions fund which shall be administered by the executive director of the postsecondary education commission. Such fund shall be nonlapsing, continually appropriated, and shall be used by the postsecondary education commission for expenses relating to its degree-granting and research and studies functions.

28:3 Postsecondary Education Commission; Workforce Incentive Program. Amend the introductory paragraph of RSA 188-D:18-f, I to read as follows:

I. The postsecondary education commission shall administer the workforce incentive program in accordance with state statutes and accounting procedures. The program shall include a forgivable loan component and a loan repayment component. All funds received pursuant to the forgivable loan component under RSA 188-D:18-g and the loan repayment component under RSA 188-D:18-h shall be nonlapsing and continually appropriated to the postsecondary education commission for the purposes of this program. The commission shall have the authority to:

28:4 Postsecondary Education Commission; Leveraged Incentive Grants. Amend RSA 188-D:33 to read as follows:

188-D:33 Program Established. The New Hampshire leveraged incentive grant program is hereby established for the benefit of students pursuing programs of study at accredited colleges within the state. All funds received pursuant to this section shall be nonlapsing and continually appropriated to the postsecondary education commission for the purposes of this program.

28:5 Postsecondary Education Commission; Granite State Scholars Program. Amend RSA 188-D:36 to read as follows:

188-D:36 Program Established; Intent. There is hereby established the granite state scholars program for the benefit of highly qualified New Hampshire residents pursuing programs of study at public colleges and universities within the state. The intent of the program is to encourage eligible New Hampshire residents to pursue public postsecondary education within the state by offering grant-based financial aid to such students. All funds received pursuant to this section shall be nonlapsing and continually appropriated to the postsecondary education commission for the purposes of this program.

28:6 Scholarships for Orphans of Veterans; Nonlapsing Funds. Amend RSA 193:19 to read as follows:

193:19 Purpose of Appropriations. The sums appropriated under the provisions of this section shall be [used] nonlapsing and continually appropriated for the sole purpose of contributing to the payment of board, room rent, books and supplies, at a New Hampshire public institution of higher education, for veteran’s natural or adopted children between the ages of 16 and 25 years, who are legal residents of the state at the time of application, whose parent served on active duty in the armed services of the United States from December 7, 1941 to December 31, 1946; or from June 27, 1950 to January 31, 1955; or from February 28, 1961 to May 7, 1975; or from August 2, 1990 through a final date of the Gulf War conflict to be prescribed by Presidential proclamation or law; or in any operation not otherwise covered by this section for which the armed forces expeditionary medal or a theater of operations service medal, as defined in RSA 72:29, has been awarded to the veteran, and the veteran, who was a New Hampshire resident at the time of his or her death, either died while on active duty during the service described above, or has since died from a service-connected disability so rated by the federal government. Not more than $2,500 shall be paid under this section to any one student in any one year, provided that no individual shall be eligible to receive such benefits for a period of more than 4 years.

28:7 Veterinary/Medical/Optometric Education Program; Nonlapsing Funds. Amend RSA 200-J:1 to read as follows:

200-J:1 Purpose. It is the intent of the general court to assure, to the greatest extent possible, the admission of qualified New Hampshire residents to educational institutions providing programs of instruction leading to the acquisition of doctoral degrees in allopathic medicine, veterinary medicine and optometry. All funds received pursuant to this chapter shall be nonlapsing and continually appropriated to the postsecondary education commission for the purposes of this program.

28:8 Application of Receipts; Workforce Incentive Program. Amend RSA 6:12, I (b)(140) to read as follows:

(140) Moneys deposited in the forgivable loan fund and the loan repayment fund in the workforce incentive program under RSA 188-D:18-f through RSA 188-D:18-h.

28:9 New Subparagraphs; Application of Receipts; Postsecondary Education Commission Scholarship Funds. Amend RSA 6:12, I(b) by inserting after subparagraph (242) the following new subparagraphs:

(243) Moneys used for the New Hampshire incentive program established in RSA 188-D:10.

(244) Moneys used for the leveraged incentive grant program established in RSA 188-D:33.

(245) Moneys used for the granite state scholars program established in RSA 188-D:36.

(246) Moneys used for scholarships to orphans of veterans program established in RSA 193:19.

(247) Moneys used for the veterinary/medical/optometric education program established in RSA 200-J:1.

28:10 Repeal. The following are repealed:

I. RSA 188-D:8-b, relative to federal loan default cost fees.

II. RSA 200-I, relative to veterinary/medical education loan program.

28:11 Effective Date. This act shall take effect July 1, 2006.
