AN ACT relative to the authority of land surveyors to enter onto land to make surveys.

ANALYSIS

This bill allows land surveyors, their agents, and employees to enter the lands of others to make surveys. Such entry is exempt from trespass but not from liability for damages.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the authority of land surveyors to enter onto land to make surveys.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Authority to Enter Onto Lands. Amend RSA 310-A by inserting after section 53 the following new section:

310-A:53-a Authority to Enter Onto Lands. Land surveyors, their agents, and their employees may enter upon the lands of others when necessary to make such land surveys. Such entry shall not constitute trespass, and land surveyors and their agents or their employees shall not be liable to arrest or civil action by reason of such entry. Nothing in this section shall be construed as giving authority to licensed land surveyors, their agents, or their employees, to destroy, injure, damage, or move anything on lands of another without the written permission of the landowner. If a land surveyor, his or her agents, or his or her employees destroy, injure, damage, or move anything on lands of another without written permission of the landowner, the land surveyor shall be liable for damages.

2 Effective Date. This act shall take effect January 1, 2007.
