STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the disclosure of certain financial documents filed with the probate court.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Access to Financial Records. Amend RSA 464-A by inserting after section 464-A:9 the following new section:

464-A:9-a Access to Financial Records Submitted to the Court. Notwithstanding any other provision of law, all accounts, inventories, records, reports, or evidence required to be submitted to the court or which may be recorded by the court pertaining to the petition or appointment of a guardian of an incapacitated person, appointment of a conservator, or duties of an administrator pursuant to RSA 554, which pertain to an individual’s income, personal property, or real property shall be subject to inspection only upon written consent of the court for good cause shown, except that heirs, legatees, law enforcement officers, creditors, and the department of health and human services shall not be required to obtain consent of the court prior to an inspection of such records. For cause shown, the court may authorize disclosure under such terms and conditions as the court may deem appropriate.

2 Effective Date. This act shall take effect January 1, 2007.
