STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing a commission to study the mission and organization of the fish and game department.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the mission and organization of the fish and game department. The commission shall study the organizational capacity of the department to fulfill its current mission and obligations, the continued efficacy of the department’s funding mechanisms, and opportunities for improvement in governance, management, and morale.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) One member of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the house of representatives, appointed by the house minority leader.

(c) One member of the senate, appointed by the president of the senate.

(d) One member of the senate, appointed by the senate minority leader.

(e) The executive director of the fish and game department, or designee.

(f) One member appointed by the State Employees Association.

(g) One member of Trout Unlimited, appointed by the executive commission of the New Hampshire Chapter of Trout Unlimited.

(h) One member of Ducks Unlimited, appointed by the executive commission of the New Hampshire Chapter of Ducks Unlimited.

(i) One member appointed by the New Hampshire Chapter of the New Hampshire Wildlife Federation.

(j) One member appointed by the Audubon Society of New Hampshire.

(k) One member from New Hampshire appointed by the Coastal Conservation Association.

(l) Three members of the general public, appointed by the governor.

II. No member of the commission shall be a current or former employee of the fish and game department.

III. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall investigate the mission and organization of the fish and game department, specifically:

I. The department’s capacity to maintain its current level of services.

II. The continued efficacy of the funding sources for the department, including long-range sustainability of funding through fish and game licenses.

III. The management and functions of the department, including recommendations on strengthening employee morale and cooperation.

IV. Overlapping and conflicting jurisdictions and responsibilities.

V. The potential for cost-saving reorganization of specific functions of the department.

VI. The review of any proposed plan to support the priority operations of the fish and game department.

4 Chairperson; Meetings. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

6 Effective Date. This act shall take effect upon its passage.
