AN ACT relative to eligibility of an owner of a dog or cat to participate in the animal population control program.

AMENDED ANALYSIS

This bill repeals the provision of law allowing a person who has adopted a dog or cat from an animal shelter to participate in the animal population control program for sterilization. This bill also allows shelters and other dog and cat sellers to advertise the criteria for eligibility in the animal population control program for sterilization.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to eligibility of an owner of a dog or cat to participate in the animal population control program.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Animal Population Control Program; Reference Deletion. Amend RSA 437-A:4, II(b) to read as follows:

(b) For all animals sterilized under RSA 437-A:3, II, the commissioner shall also reimburse, to the extent funds are available, any licensed veterinarian of this state participating in such program for an examination fee and the presurgical immunization of dogs against rabies, distemper, hepatitis, leptospirosis, and parvovirus, or an examination fee and the presurgical immunization of cats against rabies, feline panleukopenia, calici, pneumonitis and rhinotracheitis, as the case may be. Reimbursement for the full cost of the presurgical immunization shall be made by the commissioner to the participating veterinarian upon the written certification, signed by the veterinarian and the owner of the animal, that the immunization has been administered. There shall be no additional charges to the owners of animals sterilized under RSA 437-A:3, II for examination fees or the presurgical immunization. [Owners of animals sterilized under RSA 437-A:3, I who have adopted such animals from shelters shall pay the cost of all presurgical immunizations and examination fees directly to the participating veterinarian.]

2 New Paragraph; Advertisement for Spay and Neuter Program. Amend RSA 437-A:3 by inserting after paragraph II the following new paragraph:

III. Any animal shelter facility, pet store, breeder, or other facility that sells cats or dogs may display the criteria listed in RSA 437-A:3 in a prominent place and advise purchasers or adopters of cats or dogs of the criteria at the time of sale or adoption.

3 Repeal. RSA 437-A:3, I, relative to participation in the animal population control program, is repealed.

4 Effective Date. This act shall take effect 60 days after its passage.

HB 1594-FN - FISCAL NOTE

AN ACT relative to eligibility of an owner of a dog or cat to participate in the animal population control program.

FISCAL IMPACT:

      The Department of Agriculture, Markets and Food states this bill will increase state expenditures by $13,000 in FY 2007 and each year thereafter. Local expenditures will increase by $86,000 in FY 2007 and each year thereafter. There will be no fiscal impact on state, county and local revenue or county expenditures.

METHODOLOGY:

    The Department projected that fewer veterinary clinics will participate in the Animal Population Control Program, which will result in 200 fewer surgeries and 835 more animals. The Department calculates these additional animals will increase costs as follows:

    Local Costs

    300 additional animal control calls @ $200 per call $60,000

    26 rabies exposures @ 1,000 per event

    (medical costs and public health response) 26,000

    Total $86,000

    State Costs

    26 additional rabies tests per year @$500 $13,000
