STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to publication of the New Hampshire Revised Statutes Annotated.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Purpose. Article 5 of part II of the New Hampshire constitution gives to the legislature the exclusive authority to make laws. Case law resulting from decisions of courts are the product of the judicial branch and are judge-made precedent, but are not laws governing the people for the benefit and general welfare of the state. Therefore, publication of the laws of the state should not include references or annotations of case law.

2 Publications. Amend RSA 20:2-b to read as follows:

20:2-b Revised Statutes Annotated. The director of legislative services is hereby authorized to contract, with the approval of the joint committee on legislative facilities, for the editorial preparation and publication of original, replacement, or revised volumes of the official Revised Statutes Annotated and periodic supplements thereto, as necessary. Beginning January 1, 2007 all supplements, replacement volumes, and subsequent editions of the Revised Statutes Annotated shall not include case law annotations or editorial content related to judicial precedent or interpretation.

3 Effective Date. This act shall take effect 60 days after its passage.

HB 1598-FN - FISCAL NOTE

AN ACT relative to publication of the New Hampshire Revised Statutes Annotated.

FISCAL IMPACT:

      The Office of Legislative Services states this bill will increase state general fund expenditures by an indeterminable amount in FY 2007 and each year thereafter. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Office states this bill will fundamentally change the provisions of the existing contracted relationship with the current publisher of the Revised Statutes Annotated, Thomson/West. Any change in the existing contract will likely increase general fund expenditures by an indeterminable amount.
