STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to reckless endangerment of roadway workers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Highway Construction and Maintenance; Reckless Endangerment of Roadway Workers. Amend RSA 265:6-a by inserting after paragraph IV the following new paragraph:

V.(a) A person who drives a vehicle recklessly, or causes a vehicle to be driven recklessly, as defined in RSA 626:2, II(c), so as to endanger persons or property in a highway construction zone is guilty of reckless endangerment of roadway workers. A person shall be guilty of a misdemeanor if convicted under this paragraph.

(b) If a person is convicted under this paragraph, the department shall revoke his or her license for a period of 60 days for the first offense and from 60 days to one year for the second offense.

2 Effective Date. This act shall take effect 60 days after its passage.
