STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the state recycling program.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Recycled Materials; State Agency Participation Required. Amend RSA 21-I:14-a, I to read as follows:

I.(a) Each state agency, under the direction of the director, division of plant and property management, shall [develop a recycling program for post consumer recycled] recycle recyclable waste materials for which markets have been identified.

(b) Each state agency annually shall submit to the director a plan for a recycling program. The plan shall be submitted 2 months prior to the agency’s submission for budgeting purposes. The plan shall include detailed information about the types and amounts of waste regularly generated by each facility operated by that agency, whether generated in the course of operation of the facility or by the employees or clients of the facility in their daily pursuits, to include at least papers and plastics. The plan shall describe how waste shall be recycled.

(c) If an agency contracts with vendors for the provision of prepared food or the cleaning of agency facilities, willingness to recycle shall be a factor in the choice of vendors. Explanations for such decisions shall be included in the annual plan under subparagraph (b).

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1622-FN - FISCAL NOTE

AN ACT relative to the state recycling program.

FISCAL IMPACT:

      The Department of Administrative Services states this bill will increase state expenditures by $346,752 in FY 2007, $355,421 in FY 2008, $364,306 in FY 2009, and $373,414 in FY 2010. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Department states recycling will be limited to cardboard and paper only. Recycling services for paper at Concord state facilities would continue to be provided by the Tobey School Program at no cost to the State. Recycling cost for paper for locations other than Concord would be $18 for a ten-yard container that would be emptied every other week. Recycling cost to recycle cardboard would be $18 for a ten-yard container that would be picked up every other week. State agencies that lease space would be required to rent additional space to house and store recycling containers and materials. Each leased space would require a minimum of 100 square feet for storage at an average cost of $13.50 per square foot. For the purposes of this fiscal note, the Department estimates 33 leased court facilities, and 45 state-owned facilities under the care of the Department. In addition, there are 115 leased state office buildings throughout the state. Other state facilities are not included in this estimate and would increase costs. The estimated fiscal impact is as follows:

    Cardboard Recycling

    33 leased court facilities x $18 every other week x 26 weeks= $ 15,444

    45 state owned buildings x $18 every other week x 26 weeks = $ 21,060

    115 leased state buildings x $18 every other week x 26 weeks = $ 53,820

    Paper Recycling

    33 leased court facilities x $18 every other week x 26 weeks= $ 15,444

    17 state owned buildings x $18 every other week x 26 weeks = $ 7,956

    71 leased state buildings x $18 every other week x 26 weeks = $ 33,228

    Recycling Extra Storage Space

    33 leased court facilities x 100 square feet x $13.50 = $ 44,550

    115 leased office facilities x 100 square feet x $13.50 = $155,250

    Total Costs $346,752

    Assuming an increase of 2.5% per year in FY 2008 and each year thereafter, the Department estimates an increase in state expenditures of $346,752 in FY 2007, $355,421 in FY 2008, $364,306 in FY 2009, and $373,414 in FY 2010.

    In addition, this bill would require each of the 74 state agencies to develop an annual recycling plan. The Department estimates this would require each agency to dedicate an employee to spend approximately 16 hours each year to complete the plan. This could result in a fiscal impact for some agencies dependent on their level of staffing.
