STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to nondriver identification cards.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Identification Cards; Eligibility and Fees. Amend RSA 260:21, I-V to read as follows:

I. The department shall upon application issue a nondriver’s picture identification card to any resident who:

(a) Is [12] 10 years of age or older and does not possess a driver’s license, or

(b) Is disabled and does not possess a driver’s license[, or

(c) Is 65 years of age or older, whether or not said resident possesses a driver’s license].

II. The department shall, before issuing a card to an applicant, require the applicant to furnish proof of his or her age and residence.

III. The identification card shall bear the name, address, [social security] citizenship, a randomly-generated identification number, date of birth, blood type (optional), picture, and signature of the applicant[, and in the case of a card issued pursuant to RSA 260:21, I(c), said card shall bear the notation “Golden Granite State Discount Card.”].

IV. The identification card shall be valid for 5 years from the date of issuance[; provided, however, that a card issued pursuant to RSA 260:21, I(c) shall be valid for as long as the holder is a resident of the state].

V. The fee for such card shall be $10, except that the fee for any card issued by a mobile identification card facility shall be $15, and is not refundable, except that no fee shall be charged to any person who, for reason of health or age, turns in his or her driver’s license before the expiration date of such license. For purposes of this section, reasons of age shall be deemed to apply only to those persons over age 65.

2 New Paragraph; Identification Cards; Mobile Facility. Amend RSA 260:21 by inserting after paragraph X the following new paragraph:

XI. The division shall operate a mobile identification card facility for purposes of issuing identification cards at public and private schools throughout the state.

3 Disposition of Fees; Reimbursement to the Highway Fund. Amend RSA 260:22 to read as follows:

260:22 Disposition of Fees; Reimbursement to the Highway Fund. The necessary expenses incurred under RSA 260:21 shall be a charge against the operating budget of the department of safety, division of motor vehicles, motor vehicle and driver safety, driver licensing. [Pursuant to RSA 260:21, 50 percent of all fees collected] Five dollars of every fee collected under RSA 260:21 shall be credited as unrestricted revenue to the highway fund; the remainder shall be credited to the department to reimburse operating expenditures and are hereby appropriated for that purpose. [Fifty percent of all fees collected shall be credited as unrestricted revenue to the highway fund; provided, however, that 50 percent of all fees collected for cards issued pursuant to RSA 260:21, I(c) shall be credited to the state committee on aging pursuant to RSA 161-F:29]. Upon prior approval of governor and council, transfers may be made from nondriver’s picture identification card unrestricted revenue for other related expenditures, but in no event shall the cumulative annual transfers exceed 50 percent of all fees collected.

4 Effective Date. This act shall take effect July 1, 2006.

HB 1664-FN - FISCAL NOTE

AN ACT relative to nondriver identification cards.

FISCAL IMPACT:

      The Department of Safety determined this bill will increase state highway fund revenue by an indeterminable amount in FY 2007 and each year thereafter. State highway fund expenditures will increase by $577,442 in FY 2007, $320,950 in FY 2008, by $335,000 in FY 2009 and $590,732 in FY 2010. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department of Safety stated this bill intends to modify the eligibility for and the format of non-driver identification cards and would require the Division of Motor Vehicles (DMV) to issue non-driver identification cards at schools. This bill would require the DMV to implement this program using mobile units throughout the state. Currently, there are approximately forty-five 12 year olds registered with the DMV. There are approximately 470 schools in New Hampshire with approximately 34,588 students ages 10-11 that would become eligible to request a non-driver ID card. The Department of Safety cannot determine the fiscal impact on highway fund revenue, because it is not able to estimate the number of individuals who will opt for the non-driver ID cards. In order to operate this expanded program the Department provided the following operating budget that includes six new positions:

    Staffing requirements would include one Licensing Clerk and one Highway Patrol Officer per van. Equipment costs include 3 new vans at $70,000 each, fully equipped, wheel chair accessible, set up to take ID pictures with computer access, three PC’s and wireless modems at $1,575 each and three generators at $2,500 each. In-state travel is based on 26,000 miles per year at a cost of $5,250 per van.
