STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the allocation of certain off highway recreational vehicle fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 OHRVs; Individual Resident Fees. Amend RSA 215-A:23, I(a)-(b) to read as follows:

(a) The first [$7] $3 of each 2-wheeled trail bike registration or [$16] $12 of each other OHRV registration shall be appropriated to the department of resources and economic development for the bureau’s grant-in-aid program pursuant to paragraph VI.

(b) From the balance, $15.30 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in paragraph VII, and [$19.70] $23.70 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of fish and game for the purposes listed in paragraph VIII.

2 Individual Nonresident Fees. RSA 215-A:23, III is repealed and reenacted to read as follows:

III. Individual nonresident registration-$70 for each 2-wheeled trail bike registration, or $90 for each other OHRV registration.

(a) The first $9 of each 2-wheeled trail bike registration, or $22 of each other OHRV registration shall be appropriated to the department of resources and economic development for the bureau’s grant-in-aid program pursuant to paragraph VI.

(b) From the balance, $20.10 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in paragraph VII, and $40.90 from each 2-wheeled trail bike or $55.90 from each other OHRV registration shall be appropriated to the department of fish and game for the purposes listed in paragraph VIII.

3 Department of Resources and Economic Development; Land, Trails. Amend RSA 215-A:23, VII(c) to read as follows:

(c) Land purchases, easements, rights-of-way, and new construction of trails. A separate account shall be established into which [$2] $5 of each resident trail bike and other OHRV registration fee appropriated for administration of the bureau under RSA 215-A:23, I(b) and $2 of each nonresident trail bike and other OHRV registration fee appropriated for administration of the bureau under RSA 215-A:23, III(b) shall be deposited to be used only for land purchases, easements, rights-of-way, and direct costs attributed to the physical construction of ATV or trail bike trails or parking facilities.

4 Effective Date. This act shall take effect July 1, 2006.

HB 1686-FN - FISCAL NOTE

AN ACT relative to the allocation of certain off-highway recreational vehicle fees.

FISCAL IMPACT:

      The Fish and Game Department states this bill will increase state fish and game fund revenue by $287,443 in FY 2007 and each year thereafter. The Department of Resources and Economic Development states this bill will decrease state restricted revenue by $75,015 in FY 2007 and each year thereafter. There is no fiscal impact on state, county and local expenditures or county and local revenues.

METHODOLOGY:

    The Fish and Game Department indicates that the OHRV fee changes in this bill that impact the Department will increase fish and game revenue by $287,443 per year based on FY 2005 registration statistics. The table below shows the estimated revenue increases by vehicle type:

    The Department of Resources and Economic Development indicates that the OHRV fee changes in this bill that impact the Department will decrease state restricted revenue dedicated to the Bureau of Trails by $75,015 per year based on FY 2005 registration statistics.
