STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT repealing the fund for the domestic violence grant program and relative to marriage license fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Marriage License Fee. Amend RSA 457:29 to read as follows:

457:29 Marriage License Fee. The fee for the marriage license shall be $45 to be paid by the parties entering into the marriage. The clerk shall forward $38 from each fee to the [department of health and human services for the purposes of RSA 173-B:15] general fund. The clerk shall retain the remaining $7 as the fee for making the records of notice, issuing the certificate of marriage, and forwarding the $38 portion of the marriage license fee.

2 Domestic Violence Grant Program; Reference to Special Fund Deleted. Amend RSA 173-B:16 to read as follows:

173-B:16 Grant Program Established. A grant program is established within the department for the allocation of grant money to New Hampshire programs which provide aid and assistance to victims of domestic violence. The grant program shall be [funded by the fund established under RSA 173-B:15] administered by the department of health and human services with such funds as may be appropriated to the department for such purpose.

3 Domestic Violence Grant Program; Funds. Any money in the fund for the domestic violence grant program under RSA 173-B:15 on of the effective date of this act shall be appropriated to the department of health and human services for the purpose of administering the domestic violence grant program established under RSA 173-B:16. The funds shall be in addition to any other moneys appropriated for such purpose.

4 Repeal. The following are repealed:

I. RSA 173-B:15, relative to the fund for domestic violence grant program.

II. RSA 6:12, I(b)(12), relative to the deposit of marriage license fees in the fund for domestic violence grant program.

III. RSA 173-B:1, XIII, relative to the definition of special fund for domestic violence programs.

5 Effective Date.

I. Paragraph I of section 4 of this act shall take effect July 1, 2006 at 12:01 a.m.

II. The remainder of this act shall take effect July 1, 2006.

HB 1732 FISCAL NOTE

AN ACT repealing the fund for the domestic violence grant program and relative to marriage license fees.

FISCAL IMPACT:

      The Department of Health and Human Services states this bill will decrease state restricted revenue and expenditures, and increase state general fund revenue and expenditures by an indeterminable amount in FY 2007 and each year thereafter. This bill will have no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department states this bill would redirect the portion of the marriage license fee ($38) which currently goes to the special fund for domestic violence programs, to the state general fund. Expenditures for the Department’s domestic violence grant program would also be redirected from the special fund to the general fund, subject to appropriations. This bill would appropriate any funds remaining in the special fund as of the effective date of this bill, to the Department for the purpose of administering its domestic violence grant program. Approximately $350,000 from the marriage license fee is used to fund the Department’s domestic violence grant program on an annual basis. The balance of the special fund for the domestic violence program varies and may or may not exceed the budgeted amount for these funds on the effective date of this bill depending on the number of marriages that occur. The Department is unable to determine the exact fiscal impact at this time.

    The Department of State states this bill will have no fiscal impact on their Department.
