AN ACT relative to awarding the state employees health insurance plan.

ANALYSIS

This bill allows for the inclusion of the university system of New Hampshire in the administration of the state employees health insurance plan.

This bill creates a legislative committee to make recommendations and advise the commissioner of administrative services on the state employee group insurance program.

This bill repeals the law requiring a self-insured health plan for state employees.

This bill was requested by the committee studying the department of insurance and awarding of the bids for health insurance for state employees as established by 2005, 103 (HB 195).

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to awarding the state employees health insurance plan.

Be it Enacted by the Senate and House of Representatives in General Court convened:

207:1 Administration. Amend RSA 21-I:27 to read as follows:

21-I:27 Administration. Administration of the state employees permanent group life and state employees and retirees group hospitalization, hospital medical care, surgical care and other medical and surgical insurance benefits shall be the responsibility of the commissioner of administrative services. If the commissioner of administrative services concludes that inclusion of the university system of New Hampshire in the health plan would best serve the interests of the state employees and the state of New Hampshire, then the commissioner shall, with the consent of the university system board of trustees, administer the health benefits of the university system of New Hampshire employees as set forth in this subdivision.

207:2 Contract. Amend RSA 21-I:28 to read as follows:

21-I:28 Contract. The commissioner of administrative services shall be authorized to enter into permanent group life insurance contracts with an insurance company or companies, or other group licensed to do business in the state of New Hampshire. The commissioner of administrative services shall be authorized to enter into group hospitalization, hospital medical care, surgical care, and other medical and surgical benefits contracts with an insurance company or companies, third party administrators, or any organization necessary to administer and provide a health plan under the provisions of this subdivision. The commissioner of administrative services, [in consultation with the fiscal committee of the general court, shall from time to time assess the medical insurance coverage given by its present insurer and by others] shall administer contracts entered into to provide the health plan, and the coverage under the health plan, in order to determine which of various contracts would best serve the interests of the state employees and comply with the terms of the collective bargaining agreement.

207:3 New Section; Legislative Advisory Committee. Amend RSA 21-I by inserting after section 28 the following new section:

21-I:28-a Legislative Advisory Committee.

I. There is hereby established a legislative advisory committee to make recommendations on the administration of the state employees permanent group life and state employees and retirees group hospitalization, hospital medical care, surgical care, and other medical and surgical insurance benefits and to advise the commissioner concerning this subdivision. The committee shall meet as needed or pursuant to a request of the commissioner.

II. The members of the committee shall be:

(a) Three members of the house of representatives, one of whom shall be a member of the finance committee, appointed by the speaker of the house of representatives.

(b) Two members of the senate, one of whom shall be a member of the finance committee, appointed by the president of the senate.

III. The members of the committee shall serve for the duration of their legislative term, and shall receive mileage at the legislative rate when attending to the duties of the committee.

IV. The committee shall elect a chairperson from among the members.

207:4 Repeal. RSA 21-I:30-d, relative to self-insured health plans for state employees, is repealed.

207:5 Effective Date. This act shall take effect 60 days after its passage.
