AN ACT prohibiting candidates who did not get elected from serving as alternate members of the planning board or zoning board of adjustment.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT prohibiting candidates who did not get elected from serving as alternate members of the planning board or zoning board of adjustment.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appointment, Number, and Terms of Alternate Members; Candidates Prohibited as Alternates to Planning Board and Zoning Board. Amend RSA 673:6, II and II-a to read as follows:

II. An elected planning board may appoint 5 alternate members for a term of 3 years each, which shall be staggered in the same manner as elected members pursuant to RSA 673:5, II and II-a. The board shall not appoint as an alternate member anyone who was a candidate for the planning board in the election prior to the appointment.

II-a. An elected zoning board of adjustment may appoint 5 alternate members for a term of 3 years each, which shall be staggered in the same manner as elected members pursuant to RSA 673:5, II. The board shall not appoint as an alternate member anyone who was a candidate for the zoning board of adjustment in the election prior to the appointment.

2 Effective Date. This act shall take effect 60 days after its passage.
