STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the committee to study Medicaid reimbursement rates for pharmacy providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

155:1 Committee to Study Medicaid Reimbursement Rates for Pharmacy Providers Extended.

I. The committee to study Medicaid reimbursement rates for pharmacy providers, established in 2005, 73, is hereby extended for the purpose of further developing the committee’s response to issues identified in the committee’s November 1, 2005 report.

II. The committee finds that specific issues of concern include costs incurred by pharmacists in stocking drugs used on the medicaid PDL that are not on most private plans and the possibility that a lack of participating pharmacists in the medicaid program could eventually restrict meaningful access to pharmaceutical care for medicaid clients. The committee shall focus on the use of incentives and similar policy initiatives as a means of responding to such issues, including:

(a) A variable reimbursement rate that would pay a higher rate to pharmacies with a larger percentage of their business from Medicaid customers.

(b) A mail-order pharmaceutical program for Medicaid participants.

III. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

155:2 Effective Date. This act shall take effect upon its passage.
