STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT establishing a procedure for a town to withdraw from a 3-town school district.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Withdrawal From 3-Town Districts. Amend RSA 194 by inserting after section 51 the following new section:

194:51-a Withdrawal From 3-Town Districts.

I. A town that has less than 25 percent voter representation and less than 20 percent average daily student attendance in a school district made up of 3 towns and the multi-town school district has not attained the minimum scores on the average yearly progress tests for a 2-year period, may withdraw from the multi-town school district upon approval of a majority of the voters in the town proposing to withdraw. An equitable apportionment of the assets and liabilities attributable to the withdrawing town shall be made by the school board of the multi-town district, within 60 days after approval of the voters in the withdrawing town.

II. The procedures under RSA 194:47– 51 shall apply to a withdrawal under this section, except that for the purposes of this section, all references to selectman shall mean the multi-town school board.

2 Effective Date. This act shall take effect 60 days after its passage.
