STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT establishing a commission to recodify laws relating to financial contributions and disclosures and conflicts of interest and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to recodify laws relating to financial contributions and disclosures and conflicts of interest.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three persons appointed by the speaker of the house of representatives, not more than one of whom may be a member of the house of representatives.

(b) Three persons appointed by the president of the senate, not more than one of whom may be a member of the senate.

(c) Three persons appointed by the governor, as follows:

(1) One person representing the office of the secretary of state.

(2) Two members of the public.

II. Members of the commission shall serve without pay but may be reimbursed from the funds appropriated by this act for all reasonable expenses incurred when attending to the duties of the commission.

III. The first-named house member shall call the first meeting of the commission within 45 days of the effective date of this act.

3 Duties. The commission shall revise, clarify, simplify, and recodify laws relating to financial contributions and disclosures and conflicts of interest, including statutes governing:

I. Campaign finances.

II. Gifts, honoraria, and testimonials.

III. Lobbyists.

IV. Ethics of public employees and public officials.

V. The legislative ethics committee.

VI. Any related laws deemed appropriate by the commission.

4 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

5 Appropriation. The sum of $10,000 is hereby appropriated to the commission established in this act for the biennium ending June 30, 2007, for the purposes of this act. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

6 Effective Date. This act shall take effect July 1, 2005.

HB 309-FN-A - FISCAL NOTE

AN ACT establishing a commission to recodify laws relating to financial contributions and disclosures and conflicts of interest and making an appropriation therefor.

FISCAL IMPACT:

      The Office of Legislative Budget Assistant has determined this bill will increase state general fund expenditures by $10,000 in FY 2006. This bill will have no fiscal impact on state, county, and local revenue or county and local expenditures.

      This bill appropriates $10,000 from the general fund to a newly established commission in FY 2006 for the purposes of this act.

METHODOLOGY:

    The bill establishes a nine member commission to recodify laws relating to financial contributions and disclosures and conflicts of interest. Members will serve without pay but may be reimbursed from the $10,000 appropriated to the commission in this act for all reasonable expenses incurred when attending to the duties of the commission.
