HOUSE BILL 397
AN ACT relative to authority to file an abuse or neglect petition under the Child Protection Act.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to authority to file an abuse or neglect petition under the Child Protection Act.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Child Protection Act; Petition; Filed by Department of Health and Human Services. Amend RSA 169-C:7, I to read as follows:
I. A proceeding under this chapter is originated by [any person] the department filing a petition, with a judge or clerk in the judicial district in which the child is found or resides, alleging neglect or abuse of a child.
2 Emergency Interim Relief; Petition Filed by Department of Health and Human Services. Amend RSA 169-C:6-a, IV to read as follows:
IV. If the court issues ex parte orders, the department [or law enforcement officer] shall file a petition meeting the requirements of RSA 169-C:7 within 72 hours of the issuance of the orders, excluding Sundays and holidays.
3 Repeal. RSA 169-C:8-a, relative to notifying the department of health and human services of petition, is repealed.
4 Effective Date. This act shall take effect upon its passage.
