STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to all terrain vehicles used for agricultural purposes.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Certificates of Title and Registration; Agricultural Plates. Amend the introductory paragraph to RSA 261:82, I to read as follows:

I. A truck, truck-tractor [or], tractor, or all terrain vehicle with dual headlights, dual taillights, and any other equipment required by RSA 215-A, shall qualify for agricultural registration rates and number plates and shall be driven with such registration only within a 20 mile radius from the main entrance to the farm upon which said vehicle is driven, and may be used for the following purposes:

2 Certificates of Title and Registration; Agricultural Plates. Amend RSA 261:82, III to read as follows:

III.(a) A vehicle registered under this section shall not be used for the purpose of transporting goods for sale or hire, including the common or contract carriage of freight or merchandise, or for commuting to and from a place of employment, or for leisure activities.

(b) No all terrain vehicle which qualifies for agricultural number plates under this section shall be driven on any class I or class IV highway.

3 Effective Date. This act shall take effect 60 days after its passage.

SB 157 FISCAL NOTE

AN ACT relative to all terrain vehicles used for agricultural purposes.

FISCAL IMPACT:

The Departments of Safety and Resources and Economic Development have determined this bill may increase and decrease state restricted revenue by an indeterminable amount in FY 2005 and each year thereafter. The Department of Safety has also determined this bill may increase local revenue by an indeterminable amount in FY 2005 and each year thereafter. There will be no fiscal impact on county revenue or state, county, and local expenditures.

METHODOLOGY:

The Department of Safety states this bill will permit certain all terrain vehicles to qualify for agricultural number plates. The Department states it cannot estimate the number of all terrain vehicles that would qualify for agricultural plates, however, an increase in the number of agricultural plates purchased would increase state restricted Highway Fund revenue and local revenue pursuant to RSA 235:23. The Departments of Safety and Resources and Economic Development state that to the extent all terrain vehicles are registered with agricultural plates instead of an OHRV sticker, restricted revenue to the Department of Resources and Economic Development and the Department of Fish and Game pursuant to RSA 215-A:23 will decrease.
