SENATE BILL 240

AN ACT relative to transmission poles or structures on public highways.

ANALYSIS

This bill requires that any transmission pole or structure that has been replaced shall have its transmission lines transferred to the replacement pole or structure within one year. This bill also requires that all unused transmission poles or structures be removed within one year of the effective date of this act.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to transmission poles or structures on public highways.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Lines of Telegraph and Other Companies in Highways; Renewal and Replacement; Time Period. Amend RSA 231:171 to read as follows:

231:171 Renewal and Replacement. Any pole or structure or underground conduit or cable installed under license as provided [herein] in this subdivision may be renewed or replaced as occasion requires in approximately the location originally designated therefor; and any variation in location which is reasonably necessary in making such renewal or replacement in the usual or customary manner[,] shall not affect the rights of the licensee as defined [herein] in this subdivision. Any pole or structure which has had a replacement pole or structure installed within 20 feet shall have all transmission lines removed and installed on the replacement within one year of the date the replacement was installed. The person, copartnership, or corporation which last transfers its transmission lines shall remove the replaced pole or structure to ground level.

2 Removal of Existing Unused Transmission Poles or Structures in Highways. The person, copartnership, or corporation which last removed its lines from a replaced pole or structure under RSA 231:171 prior to the effective date of this act, or the owner of record if the entity which last removed its lines cannot be determined, shall remove any unused transmission poles or structures to ground level within one year of the effective date of this act.

3 Effective Date. This act shall take effect 60 days after its passage.
