STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT allowing a master electrician to have 2 apprentice electricians under his or her supervision, and relative to examinations of electricians by the electricians’ board.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Master Electricians; Apprentices. Amend RSA 319-C:2, V to read as follows:

V. “Master electrician” means a person who, as a business, hires or employs another to do electrical work, or, without hiring another, makes electrical installations as a principal or auxiliary business for his or her own account. Each master electrician may have 2 apprentice electricians working with him or her and under personal supervision.

2 Rulemaking; Examination. Amend RSA 319-C:6-a, III to read as follows:

III. How an applicant shall be examined, including the time and place of the examination, and procedures for computerized examinations;

3 Fees. Amend RSA 319-C:6-b to read as follows:

319-C:6-b Fees. The board, with the approval of the commissioner of safety, shall establish application fees for examination of applicants, fees for licensure, for renewal, and for late renewal of licenses to practice under this chapter, and for transcribing and transferring records and other services. The fee for computerized examination shall not include fees charged by and paid to a computerized examination company approved by the board. The fees established by the board shall be sufficient to produce estimated revenues equal to 125 percent of the direct operating expenses of the board for the previous fiscal year. Fees collected shall be deposited in the fire standards and training and emergency medical services fund, established in RSA 21-P:12-d, and used for the purposes of operating expenses of the electricians' board. Fees collected in excess of actual operating expenses shall be deposited in the general fund as unrestricted revenue.

4 Examinations. Amend RSA 319-C:8 to read as follows:

319-C:8 Examinations for License. Each applicant for licensure shall present to the board, on forms furnished by the board, a written application for examination and license, containing such information as the board may require, accompanied by the required application fee established by the board. Examinations shall be written[or], written and oral, or computerized as approved by the board, and shall be of a thorough and practical character. They shall include such provisions of the National Electrical Code as the board may deem appropriate. Any person failing to pass his or her first examination may be reexamined at any subsequent examination meeting of the board or by computerized examination, and thereafter may be examined as often as he or she may desire upon the payment of the required application fee as set forth in this chapter.

5 Effective Date. This act shall take effect 60 days after its passage.

SB 249 - FISCAL NOTE

AN ACT allowing a master electrician to have 2 apprentice electricians under his or her supervision, and relative to examinations of electricians by the electricians’ board.

FISCAL IMPACT:

The Department of Safety has determined this bill, as amended by the Senate (Amendment #2006-0435s), may increase state general fund revenue by an indeterminable amount in FY 2006 and each year thereafter. There will be no fiscal impact on state, county and local expenditures or county and local revenue.

METHODOLOGY:

The Department states this bill would allow for computerized testing for licensure of electricians by the Electricians’ Board. This bill would also allow the Department to establish an “application fee” that would be paid directly to a testing company and not the Department, as well as an “examination fee” paid to the Department. The Department states it cannot determine the fiscal impact of the fees until they are established and can be compared to the current fees. The Department further states this bill would allow a master electrician to have two apprentice electricians under his or her supervision, which would have no fiscal impact.
