STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT permitting seasonal camps to qualify as open space land for current use assessment.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Current Use; Definitions. Amend RSA 79-A:2, IX to read as follows:

IX. “Open space land” means any or all farm land, forest land, [or] unproductive land, or seasonal camp land as defined by this section. However, “open space land” shall not include any property held by a city, town or district in another city or town for the purpose of a water supply or flood control, for which a payment in place of taxes is made in accordance with RSA 72:11.

2 New Paragraph; Current Use; Definitions. Amend RSA 79-A:2 by inserting after paragraph XI the following new paragraph:

XI-a. “Seasonal camp land” means land which would be defined as farm land, forest land, or unproductive land under this section, except that the land contains a structure of less than 1000 square feet, not served by electricity, which is used less than 3 months per year as a seasonal camp.

3 Effective Date. This act shall take effect April 1, 2006.
