STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to the exemptions for the practice of massage therapy.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Exemptions Added; Regulation of Massage Therapy. Amend RSA 328-B:10 by inserting after paragraph II the following new paragraph:

II-a. This chapter shall not apply to the activities and services of individuals who practice other forms of tissue work exclusive of massage therapy, such as Rolfing, Trager, reflexology, shiatsu, reiki, and polarity, if those practitioners do not use the title “massage therapist” or other titles listed in RSA 328-B:2, VIII, unless they choose to meet the requirements of this chapter.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 313 FISCAL NOTE

AN ACT relative to the exemptions for the practice of massage therapy.

FISCAL IMPACT:

The Department of Health and Human Services states this bill will decrease state revenue and expenditures by an indeterminable amount in FY 2007 and each year thereafter. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

The Department assumed some individuals who practice Rolfing, Trager, reflexology, shiatsu, reiki and polarity will choose not to use the title “massage therapist” and not be licensed as a massage therapist. The Department indicates the current fee for a two-year initial license is $125 and $100 for renewal licenses. The Department assumed some savings will result if fewer licenses are issued and the Department is required to enforce the requirements of RSA 328-B on fewer licensed massage practitioners.
